Chapter 13 Bankruptcy for Child Support

Typically, my clients struggle to make child support payments despite every effort and good intention to do so. At Huebner Law Firm, PC, we know how important it is for you to be able to support your family, and we want to help you find a way to better manage your debts in order to help pay for the well-being of your children.

While Chapter 7 allows you to eliminate most of your debts, child support payments are nondischargeable. Even if you file for Chapter 7, you would still be required to pay off all of your back child support payments, and be responsible for all future payments as well. The benefit to a Chapter 7 discharge is that you are no longer responsible for most other debts, freeing your funds up for more important priorities such as child support.

My recommendation to most of my clients who are struggling with child support payments is to file for a Chapter 13 bankruptcy. This form of bankruptcy can work to restructure your past-due child support payments in a new plan, which gives you up to five years to catch up. It is important to note that actions relating to the collection of child support payments are not prohibited by the automatic stay.

Chapter 13 is preferable to individuals dealing with nondischargeable debts, do not qualify for Chapter 7, or have high-value assets that they wish to protect.

    The timeline for bankruptcy can vary on a case-by-case basis. In general, bankruptcy cases are completed between three to six months, depending on a variety of factors.
